Lučka kapetanija uz prisustvo Krune Peronje koji nam se predstavio kao odvjetnik tvrtke "Yacht Club Vranjic" došla je nasilno preuzeti posjed vranjičkog "Brodoremonta", ali za to nemaju nikakvo adekvatno sudsko rješenje, niti pravo.

Tim nas je riječima, iza vrata "pod katancem", dočekao Ivica Viljac, opunomoćenik Mirka Rapića, vlasnika bivše tvrtke "R.L.E." (brisane iz sudskog registra prije dva mjeseca, op.ur.), odnosno "Solin brodogradnje" u stečaju koja je godinama poslovala na tom prostoru, te nam pokazuje ploču koju je postavila inspekcija Ministarstva mora o zabrani korištenja prostora.

– Što se ovdje pokušava napraviti? Ovdje se siluje zakon! Oni su na temelju rezultata Vladina natječaja pokušali u prostor škvera uvesti firmu "Yacht Club Vranjic" koja je potpisala ugovor o 30-godišnjoj koncesiji na nekadašnje remontno brodogradilište.

Prema Vladinoj procjeni, ukupna koncesija je vrijedna 1,6 milijardi kuna, ali meni je cijela ta situacija vrlo sumnjiva, budući da ta firma nema niti jednog zaposlenog, nema iza sebe iskustveni rad u brodogradnji, nema djelatnika, nema prometa na računu, a bilo je još pet boljih i konkretnijih ponuda od ove... – istaknuo je Viljac i dodao:

– U Vladinim zapisnicima izričito se navodi kako će država obeštetiti gospodina Rapića prilikom proglašenja ovog prostora pomorskim dobrom, da će mu biti isplaćen novac koji je uložio, a s kamatama je riječ o više od 100 milijuna kuna, ali očito su nas prevarili. Po nama natječaj o davanju koncesije nije pošten ni korektan, nisu uzeti u obzir naši sudski sporovi koje vodimo s državom, jer Zakon o koncesijama kaže da se ništa ne može davati u natječaj dok se ne riješe sudski sporovi koje se vode pred hrvatskim sudovima.

Korisnici pomorskog dobra ustvrdili su da "neće izići dok država ne napravi rješenje o deposjedaciji koje im nisu pokazali".

– Tražimo samo da budemo pravilno obeštećeni, a "Yacht Clubu Vranjic" i tim ljudima koje ne poznajemo želimo svaku sreću u poslovanju. Nemamo ništa protiv njih, ali nećemo dozvoliti nikakvi nasilni ulazak. Lučka kapetanija nema ovlasti nikoga uvoditi u prostor, ona ima pravo samo zabraniti djelatnost. Znaju li ministar Butković i premijer Plenković što se ovdje događa, imaju li prave informacije – javno je upitao Viljac.

Budući da mu je, kako je rekao, Lučka kapetanija uz dvije obavijesti o prekršaju uručila zabranu prilaska krugu brodogradilišta na manje od 50 metara, direktor Marko Rapić nas je dočekao upravo na takvom odstojanju, u blizini doma vranjičkih vatrogasaca.

– Lučka kapetanija je 13. kolovoza došla u inspekcijski nadzor brodogradilišta i nisu utvrđene nikakve nepravilnosti, konstatirano je da je tvrtka "R.L.E." u posjedu i predloženo je provođenje generalnog upravnog nadzora nad kompletnim postupkom od osnutka škvera do danas. Ne pada mi napamet protiviti se odluci o zabrani približavanja, ali tražim pravni lijek da predmetni nalog osporim. Zvao sam danas Ministarstvo mora jer je prekršajni postupak Lučke kapetanije "delegiran" u Zagreb – ustvrdio je Marko Rapić koji je o izboru tvrtke "Yacht Club Vranjic" koja se nalazi u suvlasništvu četvorice brodara iz Krila Jesenica i Bajnica, kazao:

– Poduzeli smo pravne lijekove protiv te koncesije, predmet je išao na Upravni sud i čekamo njegovo postupanje. Čekamo također i rok od 12. rujna da budući koncesionar uplati jamstva koje su potrebna da bi pristupio ugovoru o koncesiji jer ako se jamstva ne plate sama koncesija je izvanpredmetna.

Kako smo nedavno pisali, Upravnom sudu u Splitu podnesene su dvije tužbe kojima se osporava dodjela koncesije na prostoru nekadašnjega remontnog brodogradilišta u Vranjicu. Poništenje Vladine odluke traži "R.L.E.", obrt za popravak i preinake brodova u vlasništvu Mirka Rapića (subjekt je aktualnim podacima iz registra obrtnika u - mirovanju, op.ur.) i tvrtka "Viljac" iz Trogira.

Ministarstvo: Koncesiju u ovom slučaju ostvaruje tvrtka ‘Yacht Club Vranjic‘


Kontaktirali smo i Ministarstvo mora kako bismo doznali njihovu stranu priče, a u odgovoru se navodi kako je potpisan ugovor s izabranim koncesionarom nakon čega je ta tvrtka "ostvarila pravo na gospodarsko korištenje pomorskog dobra na predjelu brodoremontnog brodogradilišta u Vranjicu".

- U cilju omogućavanja izvršenja ugovora o koncesiji, inspektori Lučke kapetanije započeli su 13. kolovoza s nadzorom dijela pomorskog dobra prilikom kojeg su zatekli više osoba u upotrebi tog dijela pomorskog dobra bez koncesije, od kojih je jedan i Marko Rapić, prokurist tvrtke "R.L.E." koja je 23. lipnja brisana iz sudskog registra te je time prestala postojati. Inspekcijski nadzor nastavljen je i u srijedu kada je Marku Rapiću izrečena mjera zabrane posjećivanja škvera na rok do osam dana zbog postojanja osnovane sumnje da je upotrebom tog dijela pomorskog dobra bez koncesije prekršio Zakon o pomorskom dobru i morskim lukama. Ovlašteni službenici Lučke kapetanije Split danas su trebali nastaviti sa započetim inspekcijskim nadzorom brodoremontnog brodogradilišta na području Vranjica, ali su ih Marko Rapić i drugi sudionici u tome nezakonito spriječili zbog čega će se inspekcijski nadzor nastaviti uz asistenciju policije - naglašavaju iz resorne administracije i dodaju kako je "gospodarsko korištenje pomorskog dobra jedino moguće uz ishođenu koncesiju što u ovom slučaju ostvaruje tvrtka 'Yacht Club Vranjic'".

Lučka kapetanija uz prisustvo Krune Peronje koji nam se predstavio kao odvjetnik tvrtke "Yacht Club Vranjic" došla je nasilno preuzeti posjed vranjičkog "Brodoremonta", ali za to nemaju nikakvo adekvatno sudsko rješenje, niti pravo.

Tim nas je riječima, iza vrata "pod katancem", dočekao Ivica Viljac, opunomoćenik Mirka Rapića, vlasnika bivše tvrtke "R.L.E." (brisane iz sudskog registra prije dva mjeseca, op.ur.), odnosno "Solin brodogradnje" u stečaju koja je godinama poslovala na tom prostoru, te nam pokazuje ploču koju je postavila inspekcija Ministarstva mora o zabrani korištenja prostora.

– Što se ovdje pokušava napraviti? Ovdje se siluje zakon! Oni su na temelju rezultata Vladina natječaja pokušali u prostor škvera uvesti firmu "Yacht Club Vranjic" koja je potpisala ugovor o 30-godišnjoj koncesiji na nekadašnje remontno brodogradilište.

Prema Vladinoj procjeni, ukupna koncesija je vrijedna 1,6 milijardi kuna, ali meni je cijela ta situacija vrlo sumnjiva, budući da ta firma nema niti jednog zaposlenog, nema iza sebe iskustveni rad u brodogradnji, nema djelatnika, nema prometa na računu, a bilo je još pet boljih i konkretnijih ponuda od ove... – istaknuo je Viljac i dodao:

– U Vladinim zapisnicima izričito se navodi kako će država obeštetiti gospodina Rapića prilikom proglašenja ovog prostora pomorskim dobrom, da će mu biti isplaćen novac koji je uložio, a s kamatama je riječ o više od 100 milijuna kuna, ali očito su nas prevarili. Po nama natječaj o davanju koncesije nije pošten ni korektan, nisu uzeti u obzir naši sudski sporovi koje vodimo s državom, jer Zakon o koncesijama kaže da se ništa ne može davati u natječaj dok se ne riješe sudski sporovi koje se vode pred hrvatskim sudovima.

Korisnici pomorskog dobra ustvrdili su da "neće izići dok država ne napravi rješenje o deposjedaciji koje im nisu pokazali".

– Tražimo samo da budemo pravilno obeštećeni, a "Yacht Clubu Vranjic" i tim ljudima koje ne poznajemo želimo svaku sreću u poslovanju. Nemamo ništa protiv njih, ali nećemo dozvoliti nikakvi nasilni ulazak. Lučka kapetanija nema ovlasti nikoga uvoditi u prostor, ona ima pravo samo zabraniti djelatnost. Znaju li ministar Butković i premijer Plenković što se ovdje događa, imaju li prave informacije – javno je upitao Viljac.

Budući da mu je, kako je rekao, Lučka kapetanija uz dvije obavijesti o prekršaju uručila zabranu prilaska krugu brodogradilišta na manje od 50 metara, direktor Marko Rapić nas je dočekao upravo na takvom odstojanju, u blizini doma vranjičkih vatrogasaca.

– Lučka kapetanija je 13. kolovoza došla u inspekcijski nadzor brodogradilišta i nisu utvrđene nikakve nepravilnosti, konstatirano je da je tvrtka "R.L.E." u posjedu i predloženo je provođenje generalnog upravnog nadzora nad kompletnim postupkom od osnutka škvera do danas. Ne pada mi napamet protiviti se odluci o zabrani približavanja, ali tražim pravni lijek da predmetni nalog osporim. Zvao sam danas Ministarstvo mora jer je prekršajni postupak Lučke kapetanije "delegiran" u Zagreb – ustvrdio je Marko Rapić koji je o izboru tvrtke "Yacht Club Vranjic" koja se nalazi u suvlasništvu četvorice brodara iz Krila Jesenica i Bajnica, kazao:

– Poduzeli smo pravne lijekove protiv te koncesije, predmet je išao na Upravni sud i čekamo njegovo postupanje. Čekamo također i rok od 12. rujna da budući koncesionar uplati jamstva koje su potrebna da bi pristupio ugovoru o koncesiji jer ako se jamstva ne plate sama koncesija je izvanpredmetna.

Kako smo nedavno pisali, Upravnom sudu u Splitu podnesene su dvije tužbe kojima se osporava dodjela koncesije na prostoru nekadašnjega remontnog brodogradilišta u Vranjicu. Poništenje Vladine odluke traži "R.L.E.", obrt za popravak i preinake brodova u vlasništvu Mirka Rapića (subjekt je aktualnim podacima iz registra obrtnika u - mirovanju, op.ur.) i tvrtka "Viljac" iz Trogira.

Ministarstvo: Koncesiju u ovom slučaju ostvaruje tvrtka ‘Yacht Club Vranjic‘


Kontaktirali smo i Ministarstvo mora kako bismo doznali njihovu stranu priče, a u odgovoru se navodi kako je potpisan ugovor s izabranim koncesionarom nakon čega je ta tvrtka "ostvarila pravo na gospodarsko korištenje pomorskog dobra na predjelu brodoremontnog brodogradilišta u Vranjicu".

- U cilju omogućavanja izvršenja ugovora o koncesiji, inspektori Lučke kapetanije započeli su 13. kolovoza s nadzorom dijela pomorskog dobra prilikom kojeg su zatekli više osoba u upotrebi tog dijela pomorskog dobra bez koncesije, od kojih je jedan i Marko Rapić, prokurist tvrtke "R.L.E." koja je 23. lipnja brisana iz sudskog registra te je time prestala postojati. Inspekcijski nadzor nastavljen je i u srijedu kada je Marku Rapiću izrečena mjera zabrane posjećivanja škvera na rok do osam dana zbog postojanja osnovane sumnje da je upotrebom tog dijela pomorskog dobra bez koncesije prekršio Zakon o pomorskom dobru i morskim lukama. Ovlašteni službenici Lučke kapetanije Split danas su trebali nastaviti sa započetim inspekcijskim nadzorom brodoremontnog brodogradilišta na području Vranjica, ali su ih Marko Rapić i drugi sudionici u tome nezakonito spriječili zbog čega će se inspekcijski nadzor nastaviti uz asistenciju policije - naglašavaju iz resorne administracije i dodaju kako je "gospodarsko korištenje pomorskog dobra jedino moguće uz ishođenu koncesiju što u ovom slučaju ostvaruje tvrtka 'Yacht Club Vranjic'".
