Dovršenim kriminalističkim istraživanjem policijskih službenika Službe kriminalističke policije ove Policijske uprave 41-godišnjak se sumnjiči za niz kaznenih djela gospodarskog kriminaliteta odnosno zlouporabu povjerenja u gospodarskom poslovanju, povredu obveza vođenja trgovačkih knjiga i povredu dužnosti u slučaju gubitka, prezaduženosti ili nesposobnosti za plaćanje.

Kriminalističkim istraživanjem je utvrđeno kako je osumnjičeni, kao osnivač i jedini član uprave i osoba ovlaštena za zastupanje i raspolaganje financijskim sredstvima trgovačkog društva iz Dubrovnika koje je sada u stečaju, u namjeri pribavljanja protupravne imovinske koristi za sebe, na različite načine, što putem bankomata, a što putem isplate u gotovini u poslovnicama banaka, sa žiro računa trgovačkog društva za sebe isplaćivao i zadržavao novčana sredstva.

Na taj je način sebi pribavio protupravnu imovinsku korist u iznosu od 79.686,78 eura na ime podignutih pozajmica te iznos od 12.800,00 eura na ime obračunatih neplaćenih kamata, a sve na štetu trgovačkog društva čija je djelatnost građevinarstvo.

Isto tako, kriminalističkim istraživanjem je utvrđeno kako je osumnjičeni otuđio imovinu - prijevozna sredstva u vlasništvu spomenutog trgovačkog društva tako što je isto ustupio ili prodao drugim osobama, a da na žiro račun trgovačkog društva nije uplatio vrijednost tako otuđene imovine niti je stečajnoj upraviteljici društva omogućio da dođe u posjed imovine društva čime je sebi pribavio protupravnu imovinsku korist od 13.723,83 eura.

Također je utvrđeno kako osumnjičeni u poslovne knjige društva nije uredno evidentirao stjecanje i otuđenje imovine te je početkom 2023. g. knjigovođi prestao dostavljati dokumentaciju koju je obvezan dostavljati i voditi Isto tako, znajući da je društvo nesposobno za plaćanje zbog neizvršavanja osnova za plaćanje u razdoblju dužem od 60 dana te da je žiro račun društva u neprekidnoj blokadi od veljače 2023. godine, čime su se stekli uvjeti za pokretanje stečajnog postupka, osumnjičeni nije podnio prijedlog za otvaranje stečajnog postupka nad trgovačkim društvom.

Opisanim kaznenim djelima pričinjena je materijalna šteta od 106.223,61 eura te je protiv osumnjičenog podnesena kaznena prijava nadležnom državnom odvjetništvu u Dubrovniku.

Dovršenim kriminalističkim istraživanjem policijskih službenika Službe kriminalističke policije ove Policijske uprave 41-godišnjak se sumnjiči za niz kaznenih djela gospodarskog kriminaliteta odnosno zlouporabu povjerenja u gospodarskom poslovanju, povredu obveza vođenja trgovačkih knjiga i povredu dužnosti u slučaju gubitka, prezaduženosti ili nesposobnosti za plaćanje.

Kriminalističkim istraživanjem je utvrđeno kako je osumnjičeni, kao osnivač i jedini član uprave i osoba ovlaštena za zastupanje i raspolaganje financijskim sredstvima trgovačkog društva iz Dubrovnika koje je sada u stečaju, u namjeri pribavljanja protupravne imovinske koristi za sebe, na različite načine, što putem bankomata, a što putem isplate u gotovini u poslovnicama banaka, sa žiro računa trgovačkog društva za sebe isplaćivao i zadržavao novčana sredstva.

Na taj je način sebi pribavio protupravnu imovinsku korist u iznosu od 79.686,78 eura na ime podignutih pozajmica te iznos od 12.800,00 eura na ime obračunatih neplaćenih kamata, a sve na štetu trgovačkog društva čija je djelatnost građevinarstvo.

Isto tako, kriminalističkim istraživanjem je utvrđeno kako je osumnjičeni otuđio imovinu - prijevozna sredstva u vlasništvu spomenutog trgovačkog društva tako što je isto ustupio ili prodao drugim osobama, a da na žiro račun trgovačkog društva nije uplatio vrijednost tako otuđene imovine niti je stečajnoj upraviteljici društva omogućio da dođe u posjed imovine društva čime je sebi pribavio protupravnu imovinsku korist od 13.723,83 eura.

Također je utvrđeno kako osumnjičeni u poslovne knjige društva nije uredno evidentirao stjecanje i otuđenje imovine te je početkom 2023. g. knjigovođi prestao dostavljati dokumentaciju koju je obvezan dostavljati i voditi Isto tako, znajući da je društvo nesposobno za plaćanje zbog neizvršavanja osnova za plaćanje u razdoblju dužem od 60 dana te da je žiro račun društva u neprekidnoj blokadi od veljače 2023. godine, čime su se stekli uvjeti za pokretanje stečajnog postupka, osumnjičeni nije podnio prijedlog za otvaranje stečajnog postupka nad trgovačkim društvom.

Opisanim kaznenim djelima pričinjena je materijalna šteta od 106.223,61 eura te je protiv osumnjičenog podnesena kaznena prijava nadležnom državnom odvjetništvu u Dubrovniku.

Dovršenim kriminalističkim istraživanjem policijskih službenika Službe kriminalističke policije ove Policijske uprave 41-godišnjak se sumnjiči za niz kaznenih djela gospodarskog kriminaliteta odnosno zlouporabu povjerenja u gospodarskom poslovanju, povredu obveza vođenja trgovačkih knjiga i povredu dužnosti u slučaju gubitka, prezaduženosti ili nesposobnosti za plaćanje.

Kriminalističkim istraživanjem je utvrđeno kako je osumnjičeni, kao osnivač i jedini član uprave i osoba ovlaštena za zastupanje i raspolaganje financijskim sredstvima trgovačkog društva iz Dubrovnika koje je sada u stečaju, u namjeri pribavljanja protupravne imovinske koristi za sebe, na različite načine, što putem bankomata, a što putem isplate u gotovini u poslovnicama banaka, sa žiro računa trgovačkog društva za sebe isplaćivao i zadržavao novčana sredstva.

Na taj je način sebi pribavio protupravnu imovinsku korist u iznosu od 79.686,78 eura na ime podignutih pozajmica te iznos od 12.800,00 eura na ime obračunatih neplaćenih kamata, a sve na štetu trgovačkog društva čija je djelatnost građevinarstvo.

Isto tako, kriminalističkim istraživanjem je utvrđeno kako je osumnjičeni otuđio imovinu - prijevozna sredstva u vlasništvu spomenutog trgovačkog društva tako što je isto ustupio ili prodao drugim osobama, a da na žiro račun trgovačkog društva nije uplatio vrijednost tako otuđene imovine niti je stečajnoj upraviteljici društva omogućio da dođe u posjed imovine društva čime je sebi pribavio protupravnu imovinsku korist od 13.723,83 eura.

Također je utvrđeno kako osumnjičeni u poslovne knjige društva nije uredno evidentirao stjecanje i otuđenje imovine te je početkom 2023. g. knjigovođi prestao dostavljati dokumentaciju koju je obvezan dostavljati i voditi Isto tako, znajući da je društvo nesposobno za plaćanje zbog neizvršavanja osnova za plaćanje u razdoblju dužem od 60 dana te da je žiro račun društva u neprekidnoj blokadi od veljače 2023. godine, čime su se stekli uvjeti za pokretanje stečajnog postupka, osumnjičeni nije podnio prijedlog za otvaranje stečajnog postupka nad trgovačkim društvom.

Opisanim kaznenim djelima pričinjena je materijalna šteta od 106.223,61 eura te je protiv osumnjičenog podnesena kaznena prijava nadležnom državnom odvjetništvu u Dubrovniku.
